Advertising Sponsors

An election advertising sponsor is a person or organization - other than a registered political party, registered constituency association or candidate - who conducts election advertising. Election advertising sponsors must be registered with the Chief Electoral Officer, even if the election advertising they are conducting does not cost any money. Advertising sponsors can also take part in initiatives and recalls.

Notice:
On March 30, 2009, the Honourable Mr. Justice Cole of the Supreme Court of British Columbia issued his written judgment on third party election advertising provisions established in the Election Act. Justice Cole found that the limit for election advertising sponsored by third parties during the 60 day pre-campaign period was an unjustified infringement of the right to freedom of expression guaranteed by the Canadian Charter of Rights and Freedoms. As a result of this decision, there is no longer a limit on the value of election advertising sponsored during the 60 day pre-campaign period (February 13, 2009 until April 13, 2009, inclusive) by a registered election advertising sponsor.

The limit for the value of election advertising sponsored during the campaign period, which begins on April 14 and ends on May 12, 2009, remains $3,000 in relation to a single electoral district and $150,000 overall.

Please note that the other provisions of the Election Act relating to election advertising remain in force. It is still necessary for election advertising sponsors to be registered with Elections BC, to include authorization statements on all election advertising conducted between now and General Voting Day on May 12, 2009, and to file reports which disclose all election advertising sponsored, including election advertising sponsored during the 60 day pre-campaign period.
